Ownership of artworks | Forgeries are a problem within the artworld. In order to combat this it is important to establish a chain of provenance right back to the artist. We have a legitimate interest to keep details of purchases, artists and owners indefinitely to prevent forgery and preserve the value of the artwork. (legitimate interest) |
Promotional communications
We may use your personal information to send you updates by email, post or social media communications about our artwork, a particular artist’s products, services, art fairs and events including exclusive offers, promotions, new artworks and new artists.
We have a legitimate interest in processing your personal information for promotional purposes (see above ‘How and why we use your personal information’). This means we do not usually need your consent to send you promotional communications. However, where consent is needed, we will ask for this consent separately and clearly.
We will always treat your personal information with the utmost respect and never sell it to other organisations outside the Albion Group of Companies for marketing purposes.
We may share your personal information for marketing purposes with third parties but only where we have engaged such third parties to market on our behalf and only in relation to our existing or new artwork, artists, events and art fairs. They will only act upon our strict instructions and we will only allow them to handle your personal information if we are satisfied they take appropriate measures to protect your personal information.

We only allow our service providers to handle your personal information if we are satisfied they take appropriate measures to protect your personal information. We also impose contractual obligations on service providers to ensure they can only use your personal information to provide services to us and/or to you. We may also share personal information with external auditors for accreditation and the audit of our accounts.
We may disclose and exchange information with law enforcement agencies and regulatory bodies to comply with our legal and regulatory obligations.
We may also need to share some personal information with other parties, such as potential buyers of some or all of our business or during a re-structuring. Usually, information will be anonymised but this may not always be possible. The recipient of the information will be bound by confidentiality obligations.
Where your personal information is held
Information may be held at our galleries and those of our group companies, third party agencies, service providers, representatives and agents as described above (see above: ‘Who we share your personal information with’).

How long your personal information will be kept
We will keep your personal information while we are providing artwork and services to you. Thereafter, we will keep your personal information for as long as is necessary:
We will not retain your personal information for longer than necessary for the purposes set out in this notice. Different retention periods apply for different types of personal information, we keep provenance records or artworks indefinitely to prevent forgeries and preserve the value of artworks. For other personal data we carry out an annual audit to establish what is still necessary. Further details on this are available in our retention schedule which is available upon request by contacting us using our details below.
When it is no longer necessary to retain your personal information, we will delete or anonymise it.
Transferring your personal information out of the EEA
To deliver services to you, it is sometimes necessary for us to share your personal information outside the European Economic Area (EEA):
These transfers are subject to special rules under European and UK data protection law. Our art, artists, galleries, events and art fairs are based around the world including our gallery in the US. The US has different laws surrounding data protection than we do in this country which may not offer the same level of protection as our laws. We therefore only use a marketing platform that has signed up to the Privacy Shield framework offering you the same level of protection as you can expect from us. Further details of this framework can be found at www.privacyshield.gov. If we use any provider who has not signed up to the Privacy Shield framework, we will ensure the transfer of any personal information complies with data protection law and all personal information will be secure. We will either obtain your consent to transfer the personal data or we will use standard data protection contract clauses that have been approved by the European Commission. Keeping your personal information secure
We have appropriate security measures to prevent personal information from being accidentally lost or used or accessed unlawfully. We limit access to your personal information to those who have a genuine business need to access it. Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality.
